These Terms and Conditions (“Terms”) govern your use of the Mission Shop website located at https://missionshop.binauralsystems.com and the purchase of products through our store. By accessing our website or placing an order, you agree to be bound by these Terms.

Mission Shop is operated by Binaural s.p., a sole trader registered in Slovenia, EU (hereinafter referred to as ‘we,’ ‘us,’ or ‘Mission Shop’).

2. Products and Print-on-Demand Model

Mission Shop sells custom-designed apparel, accessories, and home décor items (T-shirts, hoodies, mugs, tote bags, canvas prints, posters, and more).

Our products are manufactured on a print-on-demand basis through our production partners Printify and Gelato. This means:

• Each item is individually produced after an order is placed.
• Products are not held in stock — they are made specifically for each customer.
• Production typically takes 3–7 business days before shipping.

We make every effort to display product images and descriptions accurately. However, colors may appear slightly different depending on your screen settings.

 

3. Ordering and Contract Formation

By placing an order on our website, you make an offer to purchase the selected products. A binding contract is formed when we send you an order confirmation email.

We reserve the right to refuse or cancel any order at our discretion, in which case we will issue a full refund of any payment received.

You must be at least 18 years old to place an order, or have the consent of a parent or legal guardian.

 

4. Pricing and Payment

• All prices are listed in US Dollars (USD) and include applicable taxes unless stated otherwise.
• Products with multiple size or variant options are displayed with a price range reflecting the lowest and highest available variant prices.
• We accept payment via the methods displayed at checkout (credit/debit card, PayPal, etc.).
• Payment is processed securely. We do not store your full payment card details.
• Prices are subject to change without notice. The price at the time of your order confirmation is the final price for that order.

 

5. Shipping and Delivery

• We ship worldwide from production facilities operated by our partners Printify and Gelato.
• Estimated delivery times vary by destination. Typical delivery: 7–21 business days after production.
• Shipping costs are calculated and displayed at checkout before you complete your order.
• We are not responsible for delays caused by customs, postal services, or events beyond our control.
• Risk of loss and title for items pass to you upon delivery to the carrier.

 

6. Customs, Duties and Taxes

For orders shipped outside the European Union, you may be subject to import duties, customs fees, and taxes levied by your country’s customs authority. These charges are the sole responsibility of the buyer. Mission Shop has no control over these charges and cannot predict their amount.

 

7. Returns, Refunds and Cancellations

Because our products are custom-made to order, the following policy applies:

Defective or Damaged Items:

• If your item arrives damaged, defective, or incorrectly printed, contact us within 5 days of delivery.
• Send your order number, photos of the issue, and a description to [email protected].
• We will offer a free replacement or a full refund.

Right of Withdrawal:

As our products are custom-produced to your order, they are exempt from the standard 14-day right of withdrawal under Article 16(c) of the EU Consumer Rights Directive (Directive 2011/83/EU). This exemption applies to personalized and custom-made goods.

Non-Defective Returns:

• We generally cannot accept returns or exchanges for items where you have changed your mind.
• If in exceptional circumstances a return is approved, items must be unused, unwashed, and in original packaging. Return shipping costs are at the buyer’s expense.

Refunds are processed to the original payment method within 5–10 business days of approval.

 

8. Intellectual Property

All designs, graphics, logos, and content on the Mission Shop website are the intellectual property of Binaural s.p. or their respective creators and are protected by applicable copyright and trademark laws.

You may not reproduce, distribute, or use any content from our website for commercial purposes without our prior written consent.

By placing an order, you confirm that you have the right to use any custom content or artwork you submit and that it does not infringe on third-party intellectual property rights.

 

9. User Accounts

You may create an account on our website. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use.

 

10. Limitation of Liability

To the maximum extent permitted by law, Mission Shop shall not be liable for:

• Indirect, incidental, or consequential damages arising from your use of our products or website.
• Loss or damage caused by events outside our control (force majeure), including natural disasters, strikes, or carrier failures.
• Delays or failures in production or delivery caused by our third-party fulfillment partners.

Our total liability in any case shall not exceed the amount paid by you for the specific order in question.

 

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Slovenia and, where applicable, the laws of the European Union.
